Terms of Service

Welcome to Not Hollywood. These Terms of Service ("Terms") govern your access to and use of nothollywood.ai and the Not Hollywood browser-based AI video studio (the "Service"), operated by Not Hollywood ("we," "us," "our"). By creating an account, purchasing credits, or generating video with the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Not Hollywood is a hosted software service that lets you generate short-form video clips from text prompts and reference images using third-party AI video models. Video generation is metered in "credits" that you purchase in prepaid packs. One credit renders one second of 768P video with native synchronized audio; two credits render one second of 2K video.

2. Accounts

You must be at least 18 years old to purchase credits or generate video. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at zach@nothollywood.ai if you suspect unauthorized use.

3. Credits, Payments, and Billing

3.1 Prepaid credits

Credits are prepaid, non-transferable, and issued in fixed pack sizes (Starter, Studio, Feature, Blockbuster). Credits never expire for as long as your account remains in good standing and the Service continues to operate.

3.2 Payment processing

All payments are processed by Stripe, Inc. under Stripe's terms of service. We do not store your full payment card information on our servers. By purchasing, you authorize Stripe to charge your chosen payment method for the amount displayed at checkout, in U.S. dollars, inclusive of any applicable taxes.

3.3 Pricing changes

We may change pack pricing, credit-per-second rates, or supported resolutions at any time. Changes apply only to future purchases; previously purchased credits keep their original conversion rate.

4. Refunds

Our full refund policy is available at /refunds.html and is incorporated into these Terms by reference. In short: unused credits are refundable within 30 days of purchase; used credits are non-refundable.

5. Acceptable Use

You agree not to use the Service to generate content that:

• Depicts real, identifiable individuals without their consent (including deepfakes of celebrities, politicians, or private persons);
• Depicts minors in any sexual, suggestive, or violent context;
• Is intended to defraud, defame, harass, threaten, or impersonate any person or entity;
• Infringes any third party's copyright, trademark, right of publicity, or other intellectual property;
• Depicts illegal acts, incites violence, or promotes self-harm;
• Contains child sexual abuse material (CSAM), non-consensual intimate imagery, or terrorist content;
• Violates any applicable law or regulation, including U.S. export controls and sanctions.

We reserve the right to review generated content, suspend or terminate accounts that violate these terms, and cooperate with law enforcement where legally required. Credits associated with a terminated account for cause are forfeit.

6. Ownership and License

6.1 Your content

You retain all rights to the prompts you write and the reference images you upload. Subject to your compliance with these Terms, we grant you a worldwide, royalty-free license to use, reproduce, modify, distribute, and publicly display the video clips generated on your behalf, for any lawful purpose including commercial use.

6.2 License to us

You grant us a limited, worldwide, royalty-free license to store, process, and transmit your prompts, reference images, and generated video for the sole purpose of operating and improving the Service. We do not sell your generated content and we do not train our own models on your outputs.

6.3 Third-party model outputs

Generated video is produced by third-party AI models (currently MiniMax H3 via fal). Ownership and licensing of AI-generated content is an evolving area of law. You are responsible for confirming that your intended use complies with the terms of any applicable model provider and with the copyright law of your jurisdiction.

7. Watermarks

Generated videos may include a subtle "Not Hollywood" watermark. Removal of the watermark is permitted for paying customers.

8. Service Availability

We aim for high uptime but do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance, add features, or deprecate features at any time. If a generation job fails after credits are deducted, we will automatically refund those credits to your balance. If a third-party model provider outage prevents rendering for more than 48 hours, you may request a prorated credit refund for that period.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that generated content will meet your expectations. AI outputs may be inaccurate, biased, or otherwise unsuitable; you are solely responsible for reviewing outputs before use.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Not Hollywood, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) US$100.

11. Indemnification

You agree to indemnify and hold Not Hollywood harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party right.

12. Termination

You may close your account at any time by emailing zach@nothollywood.ai. We may suspend or terminate your account immediately, with or without notice, if you violate these Terms, engage in fraudulent activity, or if required by law. Sections 5, 6, 9, 10, 11, and 14 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email to the address associated with your account at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising out of these Terms shall be resolved in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
